These Terms of Service (“Terms”) govern the use of the in-the-city platform available at https://www.in-thecity.com/ (the “Platform”).

By creating an account or using the Platform, you agree to these Terms.

1. Definitions

  • Platform / Service – the online platform in-the-city
  • User – any person using the Platform
  • Tourist – a User who requests or books a tour
  • Guide – an independent individual offering tours through the Platform
  • Experience / Tour – a service provided by a Guide
  • Booking – a booking request or a confirmed booking
  • Service Fee – a fee charged by the Platform for handling the booking

2. Role of the Platform

The Platform is an online marketplace and technology service that enables Users to discover, contact, and book experiences offered by independent Guides and service providers.

The Platform does not organize, provide, operate, control, resell, or manage any tours, activities, travel services, or experiences.

The Platform is not a travel agency, tour operator, tourism organizer, or provider of linked travel services.

The Platform only provides listing, search, communication, and booking facilitation services.

3. Nature of the Platform

  • The Platform acts solely as an intermediary connecting Tourists with Guides.
  • The Platform is not a tour operator, organizer, or service provider.
  • Any agreement for the performance of a Tour is concluded directly between the Tourist and the Guide.
  • The Platform does not participate in the execution of Tours and does not collect payment for the Tour itself.

4. Registration and User Account

  • Creating an account is required to use the Platform.
  • An account may be created by:
    • persons aged 18 or older, or
    • persons aged 16–17, provided they have consent from a legal guardian.
  • Users must provide accurate and up-to-date information.
  • Users are responsible for all actions taken through their account.

5. Bookings

  • A Booking is initiated by sending a booking request to a Guide through the Platform.
  • A Booking may have the following statuses:
    • REQUESTED – pending confirmation by the Guide,
    • CONFIRMED – accepted by the Guide,
    • CANCELLED – cancelled by the Tourist or the Guide.
  • A Guide may decline a booking request without providing a reason until the Booking is confirmed.

6. Booking Terms

  1. By making a booking through the Platform, you acknowledge and agree that you are booking directly with an independent Guide and not with the Platform.
  2. The Platform acts solely as an intermediary technology service that facilitates bookings between Users and Guides.
  3. Your booking agreement is concluded directly with the Guide providing the experience.

7. Relationship Between Users and Guides

Any agreement for a tour, activity, or experience is concluded directly between the User and the Guide.

The Platform is not a party to any agreement between the User and the Guide.

Guides are solely responsible for their services, including performance, pricing, scheduling, safety, availability, licenses, permits, insurance, compliance with local laws, and cancellation policies.

8. No Travel Services or Package Travel

The Platform does not create, combine, sell, or offer package holidays, linked travel services, or bundled travel arrangements.

The Platform does not combine accommodation, transport, meals, or activities into a single travel product.

9. Payments

The Platform does not sell tours or travel services.

The Platform may charge and retain a separate booking fee, platform fee, or service fee for the use of the Platform.

Any payment relating to a tour, activity, or experience is made in connection with the agreement between the User and the Guide.

The Platform does not collect or process payment for the Tour itself and does not act as a merchant of record for any Tour or experience.

When submitting a booking request, the Tourist pays a Service Fee to the Platform.

The Service Fee is charged at the time the booking request is submitted, regardless of whether the Booking is later confirmed by the Guide.

If the Guide declines the booking request, the Service Fee is refunded to the Tourist within a reasonable period of time.

The Service Fee constitutes payment for the use of the Platform and the booking handling service. It does not represent payment for the Tour itself.

The price of the Tour is paid directly to the Guide at the meeting location on the day of the Tour.

All applicable fees and payment details are displayed in the Platform prior to confirming the booking request.

10. Cancellations and Refunds

  • A Tourist may cancel a Booking free of charge up to 48 hours before the scheduled start of the Tour.
  • If a Booking is cancelled less than 48 hours before the Tour, the Service Fee is non-refundable.
  • If a Tour is cancelled by the Guide, the Service Fee is refunded to the Tourist.
  • In the event of force majeure (including but not limited to severe weather conditions, strikes, or events beyond reasonable control), the Service Fee will be refunded.

11. Guide Responsibilities

  • Guides are fully responsible for the performance of the Tours they offer.
  • Guides are responsible for safety, accuracy of information, and compliance with applicable local laws and regulations.

12. Platform Liability

  • The Platform is not responsible for the conduct of Guides or the execution of Tours.
  • To the maximum extent permitted by applicable law, the Platform shall not be liable for personal injury, delays, cancellations, or damages arising from the performance of a Tour by a Guide.
  • The Platform's liability is limited to ensuring the proper technical operation of the Platform.

The Platform shall not be liable for any injury, death, loss, damage, delay, cancellation, accident, misconduct, dispute, dissatisfaction, or other issue arising out of or related to any service provided by a Guide.

13. Independent Guides

Guides and service providers available through the Platform are independent third parties.

Guides are not employees, representatives, agents, contractors, partners, or subcontractors of the Platform.

The Platform does not supervise, direct, control, or guarantee the conduct, quality, legality, or safety of any Guide or experience.

The Platform does not recruit, employ, appoint, train, supervise, or manage Guides.

The Platform does not verify the professional qualifications, licenses, certifications, or legal eligibility of Guides unless explicitly stated otherwise.

14. Referral and Partner Programs

  • The Platform may offer referral or partner programs to selected Users.
  • The rules and details of such programs are available in the user account or within the Platform interface.

15. Account Deletion

  • Users may request deletion of their account at any time.
  • Account deletion does not affect completed or already confirmed Bookings.

16. Disputes Between Users and Guides

Any complaint, refund request, dispute, legal claim, or issue relating to a booked experience must be resolved directly between the User and the Guide.

The Platform is not responsible for resolving disputes between Users and Guides, although it may choose to assist voluntarily.

17. Governing Law

These Terms are governed by the laws of Poland and applicable European Union law.

18. Final Provisions

  • The Platform reserves the right to amend these Terms.
  • The current version of the Terms is always available on the Platform.
  • These Terms enter into force on the date of publication.
